These Terms of Service ("Terms") govern your access to and use of Ink Drake (the "Service"), operated by Truffnet, Inc. ("Truffnet, Inc.," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Ink Drake is a web application that lets you create, organize, and share tier lists of book series, and that provides recommendations of book series based on aggregated community data. We may add, change, or remove features at any time.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.
If the Service offers accounts, you are responsible for:
Notify us promptly of any unauthorized use of your account. We are not liable for losses caused by unauthorized use of your account.
"Your Content" means the tier lists, rankings, labels, notes, and other material you create or submit through the Service.
The Service includes a catalog of book series and related metadata (titles, authors, cover art, ratings, and similar information) drawn from public and third-party sources. This content belongs to its respective owners and is provided for reference and personal, non-commercial use. Truffnet, Inc. does not claim ownership of third-party book titles, cover art, or trademarks, and their appearance in the Service does not imply endorsement.
If you believe content in the Service infringes your rights, see our copyright and takedown process in Section 6.
Our role. The Service hosts content submitted by users (such as tier lists) and displays bibliographic metadata and cover art gathered from third-party sources. We do not pre-screen or manually review all of this content, and we do not endorse it. We act as a neutral host and intend to operate consistent with the safe-harbor provisions of the Digital Millennium Copyright Act ("DMCA," 17 U.S.C. § 512) and similar laws. We respond to valid complaints and may remove or disable access to content at our discretion.
Reporting infringement (notice-and-takedown). If you own copyright in material, or are authorized to act for the owner, and believe content on the Service infringes that copyright, you may send our Designated Agent a written notice that includes:
We may remove or disable the reported material and, where appropriate, notify the user who submitted it. Note that under 17 U.S.C. § 512(f), knowingly making a material misrepresentation in a takedown notice can expose you to liability.

Counter-notification. If your content was removed and you believe it was removed in error or that you have the right to use it, you may send our Designated Agent a counter-notification that includes:
If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the relevant activity.
Repeat infringers. In appropriate circumstances, we will suspend or terminate the accounts of users who are repeat infringers.

Recommendations, ratings, catalog data, and other information provided through the Service are for general informational and entertainment purposes and are provided "as is." We do not guarantee that any recommendation will match your preferences, or that catalog information is complete, accurate, or up to date.
The Service itself — including its software, design, user interface, and the Ink Drake name and logo — is owned by Truffnet, Inc. and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights. You may not copy, modify, distribute, or create derivative works of the Service without our permission.
If you send us suggestions or feedback about the Service, you grant us the right to use it without restriction or compensation to you.
The Service may link to third-party websites or services (for example, retailer or review pages for a book). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms.
You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms or to protect the Service, other users, or Truffnet, Inc.. Upon termination, the rights granted to you under these Terms end, and Sections that by their nature should survive (including Sections 4 (license), 6, 9, 13, 14, 15, and 16) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR CONTENT SUBMITTED BY USERS OR DRAWN FROM THIRD-PARTY SOURCES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Truffnet, Inc. AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Truffnet, Inc. and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in the Northern District of California, and you consent to their jurisdiction, unless applicable law provides otherwise.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice as appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
